1. OMI Usage & Licensing Terms Overview

These terms govern the use of materials purchased from Orbital Methods Index (OMI). Purchase constitutes acceptance of these terms.

OMI materials are non-prescriptive reference frameworks intended to support engineering judgment. They do not replace project-specific requirements, customer agreements, or regulatory obligations.

2. License Grant

2.1 Standard Single Product License

The standard license provides perpetual internal-use access for one organization or one individual professional.

Permitted uses include:

•  Internal reference for engineering, verification, and acceptance activities

•  Preparation for technical reviews, Factory Acceptance Testing (FAT), and Site Acceptance Testing (SAT)

•  Internal coordination, planning, and discussion

•  Onboarding or orientation of personnel on relevant projects

•  Internal presentations referencing the materials, provided copyright notices are retained

•  Unlimited internal projects within the licensed organization. Unlimited internal projects refers to projects conducted by the licensed organization for its own internal or customer-delivered systems, provided the materials are not distributed externally.

2.2 Consultant and Independent Professional Use

Consultants and independent professionals purchasing a standard license may use the materials internally across engagements. This includes preparation, analysis, and advisory work performed for clients.

Consultants may not:

•  Provide the materials directly to clients

•  Embed substantial portions into client deliverables or reports

•  Present the materials as client-facing reference documentation

Consultants may reference insights derived from the materials in client discussions, provided no copyrighted content is disclosed. Client-facing distribution or embedding requires an extended license.

2.3 What “Organization” Means

For purposes of this license, “organization” means a single legal entity (corporation, LLC, partnership, etc.) and its employees acting within the scope of their employment.

Affiliated entities, subsidiaries, parent companies, and joint ventures are separate organizations requiring separate licenses unless covered by an enterprise agreement.

3. Restrictions

Unless authorized in writing by OMI, the following are not permitted:

  • Redistribution outside the licensed organization or individual
  • Resale, sublicensing, or commercial exploitation
  • Public posting or hosting, in whole or in part
  • Creation of derivative products or services offered to third parties
  • Use of OMI materials to train, fine-tune, or materially inform external AI models or automated content-generation systems is prohibited.
  • Removal or alteration of copyright notices or attribution

Licenses are non-transferable and remain with the original legal entity. Contact OMI to discuss transfer in the event of acquisition or merger.

Purchase grants a license to use, not ownership. All intellectual property rights remain with Orbital Methods Index.

4. Limited Excerpts

Limited excerpts may be incorporated into internal documents or presentations, provided:

•  Excerpts are not distributed outside the licensed organization

•  Attribution to Orbital Methods Index is maintained

•  Excerpts are not presented as requirements, standards, or original work

Use of substantial portions in externally shared materials requires prior written permission.

5. Extended and Enterprise Licenses

The standard license covers single-organization internal use.

Contact OMI for extended licensing if you require:

•  Enterprise-wide or multi-entity deployment

•  Client-facing or externally distributed use

•  Integration into commercial offerings or proprietary processes

•  Training programs delivered to external parties

Enterprise pricing is available upon request.

6. Refund Policy

6.1 General Policy

All OMI products are delivered as digital downloads providing immediate access to proprietary intellectual property. All sales are final once access has been granted.

6.2 No Refunds For

•  Change of mind after purchase

•  Failure to review product descriptions prior to purchase

•  Disagreement with methodology, scope, or positioning

•  Inability to achieve specific outcomes or obtain customer acceptance

•  Internal procurement or approval issues after purchase

6.3 Exceptional Circumstances

OMI may, at its sole discretion, consider a refund for:

•  Duplicate purchases made in error

•  Technical issues preventing access that cannot be resolved

Refund requests must be submitted in writing within 7 days of purchase and before substantial use or distribution, as determined by OMI

No partial refunds are offered for bundled products or individual components.

7. Disclaimers

7.1 No Certification or Compliance Authority

OMI materials:

•  Do not establish requirements, standards, or acceptance criteria

•  Do not certify, qualify, or validate any system

•  Do not represent compliance with any regulation, standard, or authority

Responsibility for compliance with contractual, regulatory, and customer requirements remains solely with the user.

7.2 No Warranty

OMI materials are provided “as is.”

Orbital Methods Index makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or completeness.

Use of the materials does not guarantee acceptance by any customer, authority, or stakeholder.

7.3 Limitation of Liability

To the maximum extent permitted by law, Orbital Methods Index shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the materials, regardless of the theory of liability.

Total liability for any claim arising under this license shall not exceed the amount paid for the materials.

8. General Terms

8.1 Severability

If any provision of these terms is found unenforceable, the remaining provisions continue in full force.

8.2 Entire Agreement

These terms constitute the entire agreement between the purchaser and OMI regarding the licensed materials, superseding any prior communications or representations.

8.3 Amendments

OMI may update these terms for future purchases. The terms in effect at the time of purchase govern that transaction.

8.4 Governing Law

These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles.

Any disputes shall be resolved in the state or federal courts located in New Jersey, and the parties consent to the jurisdiction of such courts.

All materials are copyrighted works of Orbital Methods Index. All trademarks, trade names, and framework identifiers are the property of Orbital Methods Index.

Can consultants use this?

Yes. Consultants and independent professionals may use the materials internally across engagements, including for preparation, analysis, and advisory work performed on behalf of clients. Is this per project or perpetual?

Perpetual. The standard license provides perpetual internal-use access with no expiration date. You may use the materials on an unlimited number of internal projects within your organization.

Can I share internally?

Yes. The license covers your entire organization (single legal entity) and all employees acting within the scope of their employment. You may use the materials for internal presentations, onboarding, coordination, and discussion, provided copyright notices are retained. Affiliated entities, subsidiaries, and parent companies are required to obtain separate licenses.

Can I reference OMI materials in contracts or proposals?

Allowed by reference, not embedding content.

Can I use this on multiple sites or facilities?

Yes, provided all sites are part of the same legal entity. The license covers your entire organization regardless of geographic location. If different facilities operate under separate legal entities, each requires its own license.

Can I print copies for my team?

Yes. You may print copies for internal use within your licensed organization.

What if my company gets acquired?

Licenses are non-transferable and may not be reassigned to another organization or individual without prior written consent from OMI.

Do you offer enterprise licenses?

Purchase & Access

What file formats are included?

All materials are delivered as locked PDFs.

How do I access the materials after purchase?

After purchase, you will receive an email with download links. If you create an account during checkout, you can log in at any time to download your purchased materials again. An account is required for repeat access.

Can I get an invoice for procurement?

Yes. We provide invoices and accept purchase orders. Payment by check or bank wire is also available. Contact us for procurement documentation.
